Accessories of Distinction Limited reserves the right to change the terms and conditions as and when necessary. Notification of any such modifications will be listed on the terms and conditions page of the "Website" after which the "Customer's" continued use of the site will be indicative that they have accepted the modified terms and conditions

Definitions

1. The person accessing the Website and / or submitting an order to Accessories of Distinction Limited through it or via another means including phone, fax or post will hereinafter be known as the Customer
2. Accessories of Distinction Limited will hereinafter be known as Accessories of Distinction
3. www.accessoriesofdistinction.co.ukwill hereinafter be known as the Website

Order Process

• Orders can be placed by telephone, via the Website, or by post or fax using the downloadable order form
• Once the product selection has been made by the Customer, he or she must then complete all compulsory fields on the order form or supply this information verbally by telephone and agree to the terms and conditions otherwise the order will not be accepted as it is not deemed as complete
• If placed online, once all the necessary fields have been duly completed and the payment processed, the order will be provisionally considered to be complete and a printable order acknowledgement page will be automatically generated
• Within 24 hours of receipt of the online order by Accessories of Distinction, the Customer will receive an email confirming products ordered and the total amount of the transaction
• Receipt of orders submitted by post or fax will be acknowledged by post or fax accordingly unless requested otherwise by the Customer
• Telephone orders will be confirmed in writing by email, post or fax according to the Customer's wishes
• However, no provisional confirmation by email, post or fax constitutes a guarantee that Accessories of Distinction can fulfil the order. If any of the information provided by the Customer is found to be incomplete, incorrect or fraudulent, the order will henceforth be deemed as void and the Customer will be informed of this by Accessories of Distinction

Prices

• The prices listed by Accessories of Distinction on the Website are subject to change without prior notice
• The Customer is entitled to receive the prices listed by Accessories of Distinction on the Website at the time of placing their order
• All prices shown on the Website are in GBP (Great Britain Pounds) and include VAT (Value Added Tax)
• Product prices listed by Accessories of Distinction do not include carriage / delivery charges unless specified otherwise in the product description
• Carriage charges are subject to the destination (deliveries can be made within the UK or the EU) and added to the total value of the order

Payment

• Payment is required when the order is submitted by the Customer
• Online orders will not be accepted by Accessories of Distinction prior to the completion of all the compulsory fields in relation to the Customer's credit or debit card details
• Orders placed by post must be accompanied by payment by cheque or the Customer's credit or debit card details. Cheques should be made payable to Accessories of Distinction Ltd
• Orders sent by fax must include the Customer's credit or debit card details
• Payment for telephone orders must be made by credit or debit card
• Accessories of Distinction accept the following types of credit or debit cards: Mastercard, Maestro, Visa, Visa Debit / Delta, Visa Electron
• All credit or debit card payments are processed using a secure server. No information will be passed onto any third party and details are treated as confidential in accordance with the data protection act
• No goods will be dispatched by Accessories of Distinction until the credit or debit card details provided by the Customer have been verified and the payment fully processed or until the cheque sent by the Customer has fully cleared

Completion & Dispatch of Orders

• Accessories of Distinction will inform the Customer by email, post, fax or telephone when any of the ordered goods have been dispatched and this will constitute the full acceptance and completion of the order
• A contract between Accessories of Distinction and the Customer does not come into existence until such time as any of the goods ordered by the Customer are dispatched by Accessories of Distinction
• Any and all contracts formed between Accessories of Distinction and the Customer will be interpreted, construed and enforced in all respects in accordance with the laws of England and Wales. Accessories of Distinction and the Customer irrevocably submit to the exclusive jurisdiction of the English courts
• After receipt of payment from the Customer and at such time as any of the goods ordered by the Customer are dispatched by Accessories of Distinction, ownership of these goods will henceforth pass to the Customer
• Unless the Customer indicates otherwise, Accessories of Distinction will assume that the Customer will accept partial and / or split dispatch and delivery of goods ordered. If goods remain on back order, Accessories of Distinction will inform the Customer of this in writing by email, post or fax and indicate the estimated dispatch date of the outstanding goods ordered

Lead Times & Delivery Dates

• Accessories of Distinction cannot fully guarantee any lead times or delivery dates as these may be dictated by its suppliers and / or other third parties or circumstances beyond their own control
• Unless specified otherwise in the product description on the website or in writing by email, fax or post by Accessories of Distinction after receipt of the order, Accessories of Distinction will endeavour to deliver all goods ordered to the Customer within 30 days
• Should the Customer require a shorter lead time or a specific delivery date, he or she can request this in writing by email, post or fax and Accessories of Distinction will do their best to meet the needs and wishes of the Customer. However, this is at the discretion of Accessories of Distinction and subject to the immediate availability of the products in question
• Following the communication from Accessories of Distinction that goods have been dispatched, if within the UK, the Customer should receive delivery within 2 working days, and if outside the UK within the EU, the Customer should receive delivery within 7 working days. The Customer must advise Accessories of Distinction, if the goods have not been received within these indicated times, so that the post office or other courier service provider can be contacted to ensure prompt delivery

Claims, Cancellations & Returns

• Claims for damaged, faulty or missing items must be notified by the Customer to Accessories of Distinction in writing by email, fax or post within 3 working days after receipt or the anticipated receipt of the goods. This does not affect the statutory rights of the Customer
• The Customer may choose to have goods damaged, faulty or lost in transit replaced or to cancel the order. Accessories of Distinction will pay for the cost of delivery for any replacement items, if the goods were damaged, faulty or lost in transit
• Accessories of Distinction may ask the Customer for photographic evidence of product damage or faults and / or request that the item in question be returned for inspection. The Customer will be reimbursed for the return delivery cost of any damaged or faulty product
• With prior written authorization from Accessories of Distinction the Customer may arrange to return accessories which do not prove to be suitable after receipt providing that the product has not been custom-made (for example shoes which do not fit). The Customer must return the goods at their own cost, but Accessories of Distinction will incur the delivery cost of replacements. Other terms as below for returning goods also apply
• Under the distance selling regulations the Customer has the right to cancel their order prior to delivery and subsequently within 7 working days after receipt of the goods from Accessories of Distinction
• Notice of cancellation must be given by the Customer in writing to Accessories of Distinction by email, fax or post
• Should the Customer cancel the order under the distance selling regulations, they must return the goods to Accessories of Distinction at their own expense with the original packaging. It is the Customer's statutory duty to take reasonable care to ensure that the goods will not be damaged in transit and to send them by a postal or courier service which can be tracked and insured
• Throughout the period of cancellation the distance selling regulations stipulate that the Customer has a statutory duty to retain possession of the goods and to take reasonable care of them. Security tags should not be removed from the product until the Customer has fully accepted it
• The distance selling regulations do not apply to perishable goods such as chocolates, any product personalized or made to the Customer's specification including custom-made crackers, ring pillows and guestbooks or for hygiene reasons any goods that may have been worn such as pierced earrings (unless as part of a jewellery set). No returns will be accepted and no refunds given for items which fall into the above categories except if damaged or faulty
• No goods shall be returned by the Customer without prior agreement in writing from Accessories of Distinction
• If no such claim or cancellation as detailed above is received by Accessories of Distinction within this specified time, the products shall be deemed to have been accepted by the Customer
• Refunds including the original standard delivery charges will be given within 30 days of the Customer's notice of cancellation
• Any additional charges agreed by the Customer for an express delivery service will not be refunded

Breach of the Terms & Conditions

• In the event that the Customer is in breach of any of these terms and conditions, Accessories of Distinction shall be entitled to refuse to supply the Customer with any further goods and / or to suspend delivery until such time as all breaches have been remedied

Limitation of Liability

• Accessories of Distinction shall not be liable for any loss or damage sustained or incurred by the Customer or any third party unless it is caused by the negligence or wilful misconduct of Accessories of Distinction or its employees and then only to the extent of the original value of the goods
• Under no circumstances will Accessories of Distinction be liable for consequential loss

Statutory Rights

• These terms and conditions do not affect the Customer's statutory rights
• If any term is held by any competent authority to be invalid or unenforceable in whole or part, the validity of the other provisions of the terms and conditions and the remainder of the provisions in question shall not be affected
